Simplification of procedures for fragmented domestic industries – International Trade Law Update #50

On July 29, 2021, DGTR issued Trade Notice 09/2021 providing guidelines to enable fragmented domestic industries to file applications for ADD/CVD measures.
 
Footnote to Article 5.4 of the WTO Anti-Dumping Agreement allows application to be filed by fragmented industries involving large number of producers. However, there was no clarity under domestic rules on how to deal with such scenarios.
 
In order to overcome such difficulty, Trade Notice now allows domestic producers constituting domestic industry to file basic injury information as per prescribed format. Further, DGTR may now resort to selecting a sample set of producers and seek additional information for calculating injury margin.
 
This is a welcome step and will now make it easier for fragmented industries to file application for trade remedy measures.
