Since inception of GST, the interplay between GST and Customs laws has been a mystery for exporter community. Regular amendments and restrictions in Customs and FTP have led to multiple controversies hovering over them. The recent shock to exporters has come in the face of High Court ruling of Cosmo Films v. UOI, 2020-VIL-514-GUJ, where the Gujarat High Court held the amendment restricting IGST refund on exports made by Advance Authorisation Holders and EOUs will be retrospective in nature.
