
Anti-dumping duty on Aluminium foil – International Trade Law Update #41
On June 18, 2021, DGTR has recommended levy of anti-dumping duty on import of Aluminium foil 80 microns and below originating from China PR, Malaysia, Thailand and Indonesia. The scope of the above product includes home foil, gauge, cigarette foil, etc. The Authority has also excluded number of product types from the ambit of ADD levy.
Interestingly, DGTR has made several key observations in final findings such as:
- Even if there is capability to produce a certain grade, but is not produced by domestic industry; such grades are to be excluded
- Demand supply gap in the country is not relevant as foreign producers may fill the gap at undumped prices
- Existence and sustainability of a domestic production base is important for general economic development which has to be protected against injurious dumping
- Imposition is in overall public interest as impact on consumers will be miniscule while allowing indigenous production of product concerned at the same time.
Ministry of Finance has three months to accept / reject the recommendation of DGTR.
