Article 54 – “Advance Ruling Mechanism under GST Laws: A Stitch in Time, Saves Nine” 

The Indian Legal System is reeling under a docket explosion and the Government and Authorities are active contributories to the deluge’.

The above words were used by Hon’ble Supreme Court highlighting failure of dispute resolution mechanism in India. In 1993, India established advance ruling mechanism to provide alternative dispute resolution mechanism through which a taxpayer could plan its business activities in advance. But in reality, the mechanism could not achieve its desired objective due to tax administration’s compulsive approach and delays. Resultantly, the Courts are flooded with superfluous disputes.

Through this article, Our Managing Partner, Mr. Puneet Bansal and Senior Associate, Mr. Sourabh have tried to advocate the need of an appropriate mechanism to eliminate tax litigation and parallelly achieve tax compliance.
