Date of implementation of amendments in Legal Metrology (Packaged Commodities) Rules, 2011 extended to October 1, 2022

We discussed on various transitional issues pursuant to amendments in Legal Metrology (Packaged Commodities) Rules, 2011 (‘LMPC Rules’) brought in by Notification No. GSR 779(E) dated November 2, 2021 which was coming into effect from April 1, 2022.

The Central Government has recently issued Extension Notification dated March 28, 2022 vide which effective date of aforesaid Notification has been extended to October 1, 2022. [Refer:]. Accordingly, amended LMPC Rules shall apply from October 1, 2022.

Apart from extension of date of implementation, Extension Notification has brought in following clarifications / amendments:

  • No requirement to mention Unit Sale Price (as required vide amended LMPC Rules) when Unit Sale Price equals to Retail Sale Price
  • No prosecution against manufacturer or packer or importer of pre-packaged commodities even if they use amended labels from April 1, 2022
  • Removal of Second Schedule which lists commodities required to be packed in standard quantities under Rule 5 of the LMPC Rules (Rule 5 was omitted vide amended LMPC Rules). Correspondingly power available with Government to relax applicability of this Rule is also removed

NITYA Comments: The grace period of 6 months comes as a big relief for the industry. As this extension has come at last moment, many companies would have already implemented changes in their packaging / labels.

Pertinently, there is an anomaly in the English version of Extension Notification as the same extends time limit of applicability of original LMPC Rules and not amended LMPC Rules. However, a look at Hindi version of Extension Notification and considering overall purpose of the same, it is clear that only amended LMPC Rules have been extended.
