Non acceptance of MEIS claims by ICEGATE portal

We apprised you that the Delhi High Court has also accepted challenge to capping benefits under Merchandise Exports from India Scheme (‘MEIS’).

To add to exporters’ woes and much to everyone’s surprise, ICEGATE portal has stopped accepting MEIS claims even before last date of filing the same viz. December 31, 2021. The message being displayed on portal is that total claims filed till date for period September 2020 to December 2020 exceeded allocated budget of Rs. 5,000 crores.

Notably, Notification No. 30/2015-2020 dated September 1, 2020 (‘Notification’) capped MEIS reward at Rs. 2 crore per IEC holder and stated that cap was subject to further downward revision to ensure that total MEIS claims do not exceed allocated budget of Rs. 5,000 crores.

NITYA Comments: This restriction on ICEGATE portal is arbitrary and in direct contradiction with Notification. Notification stated that there will be further downward revision in cap and not that claims need to be filed on first-come first-served basis. Exporters are advised to represent DGFT and file manual claims by December 31, 2021, if this issue does not get resolved in next couple of days. Exporters must also consider filing Writ Petitions if such restriction persists.
