
Proposed time limit for availment of ITC, adjustment of Credit Notes and rectification in GSTR-1 and GSTR-3B
As you are aware, the Finance Act, 2022 proposed to change due dates of following GST compliances of any Financial Year (‘FY’) from due date of filing of GSTR-3B of September of succeeding FY to November 30 of succeeding FY or date of filing annual return, whichever is earlier:
- Last date of availing ITC
- Furnishing of details of Credit Notes in GSTR-1
- Rectification of GSTR-1
- Rectification of GSTR-3B
Notably, the abovementioned amendments have not been made effective yet.
NITYA Comments: Since the above amendments have not been made effective, due date of abovementioned compliances for FY 2021-22 continues to be due date of filing GSTR-3B of September 2022 (October 20, 2022) or actual date of filing annual return for FY 2021-22, whichever is earlier.
Considering this, taxpayers must factor in limited time for availing any missed ITC, furnishing details of Credit Notes in GSTR-1 or rectifying returns for FY 2021-22 and accordingly timely undertake ITC & other reconciliations.
